Sir Garnet reported in the first days of October 2012. Same time i copied it to the beta forum and, shortly afterwards, played it with a we-have-a-shared-enemy-faction in the MS87 scenario and could destroy all forces of Sulla, but not take the cities back from the pirates, especially on the islands.
this however was in the first days of October and afterwards the change was made and, for my games, it did not happen again. We got the public beta just like you, i recall.
your report is from the November 22nd, one week after the patch became a normal, public patch. as i dont suppose the problem to be case-sensitive, but generic (i cant attack them, for they are friendly to my enemies enemies), i postulate that the changed fix was lost in the second week of November.
I had to stop testing in end of October, thus i can narrow it in on the first two weeks of November either. taht would confirm your observation.
