I´ve experienced a stack that retreats to a region where his faction has only a 5-4% of military control. I thought (as stated in the manual and in the wiki) that´s not possible with less than 6%. Any idea on this? It was under patch 1.04 RC1.

The value in GameLogic.opt is 0%

A change was made in patch 1.03 to reduce huge losses being encountered.
