No Privateers in the 1812 scenario

Recently I have played a couple of game of the war long 1812 scenario. Neither my opponent nor I could build privateers. I am wondering two things:
1. Have others seen this issue? We both have clearly sufficient EP to build the fleets.
2. Does someone have a fix like maybe a quick file update?
While this American frigates are probably sufficient naval resources for the USA, these privateers might be a nice addition. I am certain that I have never seen it before as I have never tried to build privateers in this scenario.
