BoA 1.12a patch doesn't work

Hi. I just installed the game out of the box (v.1.09b). Then I tried to apply the 1.12a patch. I get the following error message:
C:\Program Files\Birth of America\BoA.exe
An error occurred while trying to replace the existing file:
DeleteFile failed: Code 5
Access is denied
Any assistance greatly appreciated.
