Conquer a city with a draw

September 1775:
Lord Dunmore's army (Mx4, Mx4, Rx1) is in defensive posture in the region Norfolk. In the city the rebels (no leader, Mx4, Mx4).
October 1775:
The rebels attack. Not a smart move since they don't outnumber me, the terrain is bad (mud), they don't have a leader, can't be out of supply (in difference to me: no supply waggon).
They are lucky: a draw. Nevertheless I gain control over Norfolk and the rebels are outside now.
Seems a little bit strange to me. Is this meant to be like this?
